What changed? Job, health, divorce, relocation? Document it — the lender needs a hardship letter.
Order a title search. Know exactly what's owed: primary, HELOC, HOA arrears, IRS, judgment liens, solar panels.
What can the home realistically sell for? Compare distressed vs. retail comps. Be honest, not optimistic.
Set timeline expectations: 60–150 days. Lender approval required. Seller doesn't 'accept' — lender does.
Signed 3rd-party authorization form. Without it, the lender won't talk to you. Non-negotiable first step.
What Every Lender Will Require (Assemble Before You Call)
Call the Loss Mitigation department, NOT customer service. Ask for the short sale or 'workout' team specifically.
Every call: document the rep's name, employee ID, date, time, and what was said. This is your paper trail.
60–90 minute holds are normal. Use a headset. Have your file open. Be patient, rudeness costs you deals.
The lender will order a Broker Price Opinion. If it comes in high, the deal dies. Provide your CMA proactively.
If your file stalls, ask for a supervisor or send a written escalation. Be professional but persistent — squeaky wheel gets the grease.
Fannie/Freddie/FHA/VA/Private — each has different short sale guidelines, timelines, and approval authorities.
Lead with 'Short Sale, Lender Approval Required. Priced to sell. Motivated seller.' Be factual, not apologetic.
Below-market pricing attracts investors and patient buyers. Highlight value, not the distress.
'Allow 60–90 days for lender approval' in ALL marketing. Protect yourself and attract serious buyers only.
Investors (cash, fast close), first-time buyers (patient + FHA), and relocation buyers (long timelines).
Position as a 'value opportunity' not a distress sale. 'Undermarket pricing while lender review is pending.'
Network with buyer's agents at your brokerage. Pre-selling before MLS cuts timeline dramatically.
You Are Negotiating Against a Business Decision, Not a Person
Incomplete files get deprioritized. Submit everything at once, organized, clearly labeled.
Show the lender their net recovery, make the math easy for them to say yes.
If BPO is too high, submit distressed comps, repair estimates, neighborhood trends. Push back professionally.
Ask for it in writing. Many lenders will waive if the seller cooperates and the file is clean.
Go up the chain: team lead → supervisor → ombudsman. Document every step.
If lender won't negotiate in good faith and the seller faces foreclosure anyway, know the timelines.
Unlike non-recourse states, Texas lenders CAN pursue deficiency judgments after a short sale. ALWAYS recommend the seller consult a licensed Texas real estate attorney before proceeding. This is not legal advice, but it protects the seller and your license.
Required on all Texas short sale listings. Discloses lender-approval contingency. Explains seller's rights if lender does not approve. Get it signed with the listing agreement, not as an afterthought.
North Texas Real Estate Information Services (NTREIS) requires short sales be listed as such on MLS. Misrepresentation is a violation. Mark accurately: 'Short Sale, Lender Approval Required.'
Homestead property has additional protections in Texas. In some cases this affects the lender's ability to pursue a deficiency. This is another reason to involve a Texas real estate attorney early in the process.

Most lenders approve 5–6% total. Protect your side. Negotiate if they attempt to cut. Get it in the approval letter.
